We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel the quantity of items purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made.
We do not guarantee that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Orders and Payments
Your credit card and payment details will not be held on our system. More information about data security, including how we process payments, can be found in our Privacy Policy.
We may also offer alternative payment options during the checkout process. You may also process an order by telephone or via a payment link; however, no order is processed by us until payment is completed.
We reserve the right to hold deliveries if your payment method is not valid or it has been refused by the card network.
Where we accept an order, we do all that we can to ensure that your order is fulfilled. Products are, however, subject to availability and market conditions. If we are unable to deliver an item you have ordered, we will contact you and may offer a reasonable substitute or a refund. You may reject that substitute, and you will not be charged for it. If we do not provide a substitute or you reject our substitute, we will remove both the original Product and the substitute from your order so that you are not charged for them. We will, however, bear no liability for the unavailability of Products.
All prices for Products are inclusive of any applicable VAT at the applicable current rate chargeable in the UK. The prices of our Products do not include delivery fees. Our delivery fees are as quoted on our Website. Delivery fees will be automatically added, where applicable, on the shopping basket page based on the value of the items in your basket and the selected delivery service.
The images of the Products on our site are for illustrative purposes only, although we have made every effort to display the products accurately. Your products may vary slightly from those images. The packaging of the Products may vary slightly from that shown on our website, too.
Delivery
We will fulfill your order based on the fulfillment service you select on the Shopping Basket page. Unless you are collecting your order from our store, we will deliver your order to the delivery address you confirm on the Checkout pages. It is your responsibility to enter a valid and accurate postcode that coincides with a postcode we deliver to. Any changes to your delivery details must be received by us as soon as possible in order for us to try and meet those change requests. You remain responsible for ensuring that any such change is not only transmitted by you but received by us.
We reserve the right to refuse to accept orders from any customer, to adjust the cost for the delivery, if required, and then not to deliver to all international locations.
You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that you give us instructions to leave your delivery in a safe place, we will not accept liability for the order once we have delivered it to the safe place. In the event if the delivery is stolen from your doorstep or damaged while our delivery person is there, we do not accept liability and will offer compensation at our discretion.
If we are unable to deliver to you, or must provide late, for reasons beyond our control, including, but not limited to, adverse weather conditions, strike action, vehicle breakdown, traffic congestion, peak time seasons, bank holidays delays, Royal Mail and/or ParcelForce congestioned operations, COVID-19, or supplier failure, we shall not be liable for any inconvenience or loss caused.
You must inspect the Products upon delivery. You must notify us as soon as possible after delivery if you find any defects, by emailing us or writing to us at the email address shown on our Website. We will replace or refund you for defective Products. Otherwise, our liability is limited as provided below.
If no one is home when we deliver your order using our own vans, and you have not provided us with any specific delivery instructions, we will either return the order to our facilities or attempt to leave it with a neighbour. If we return the order to our facility, we will contact you to attempt redelivery. We reserve the right to impose a delivery fee for redelivery that does not exceed the maximum delivery fee we can charge to other customers in your postcode, even if your order originally had any delivery fees waived. We also reserve the right to take payment over the phone for the redelivery.
If nobody is home when your order is delivered by one of our courier services, one more free of charge delivery attempt may be made by the courier. You will receive an email notifying you that the parcel has been handed over to our courier along with an expected delivery date and time. You will be able to track, rearrange and provide additional instructions directly with our courier. If your order includes chilled products, it is your responsibility to be at the designated delivery address on the date and time of delivery. We will not be responsible for the condition of chilled products resulting from unsuccessful deliveries if you are not at the designated delivery address on the day of delivery.
Where we deliver using a courier service, we will endeavour to pack products as carefully as possible to ensure that neither the packaging nor the product is damaged or broken.
Cancellation and refunds
We may suspend or cancel any accepted order at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.
When you shop online, you have the right to return non-perishable Products if the packaging has not been opened, provided you return them before the expiry date. To do that you have to inform us by sending an email to emarkets.uk@gmail.com within 14 days of receiving your order. You then have an additional 14 days to return the items. You do not have to provide a reason for your refund. Saturdays, Sundays and public holidays are included in mentioned periods. You will need to arrange a return at your own expense of any such non-perishable goods.
After the products have been received by us, we will credit your payment card with the price (if any) that you have paid for cancelled products less our reasonable costs in collecting the goods.
Where we have assessed reasonable costs for the cancelled products, we will be transparent about them and agree them with you in advance.
Warranties and Liabilities
We try to ensure that material included on the Website or in any other catalogue or materials is correct, but we cannot accept responsibility if, despite our endeavours, this is not the case. Without prejudice to your statutory rights, we may correct any inaccuracies and/or errors, and we will not be responsible for any such inaccuracies and/or errors or for the results obtained from the use of such information or for any technical problems you may experience with the Website.
We warrant that the products will be of satisfactory quality and, therefore, if the Products which you purchase from us are faulty or defective you should notify us in accordance with Section 7. We will examine the Products and, if the Products are faulty or defective we will replace the faulty Products or refund the price of the faulty or defective Products.
The warranty above does not apply to faults or defects which have been caused by your misuse and/or neglect of the Products or by accidents caused while the Products are in your possession.
We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for:

Subject to the provisions of this Section, our entire liability in connection with the contract for the supply and purchase of Products and will not exceed the purchase price of the Products in question.

Nothing in these Terms and Conditions means that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents or subcontractors is limited.
We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control such as but not limited to fire, flood, adverse weather, acts of God, strikes, labour disputes, riots, civil unrest, accident, disruption to energy supplies, COVID-19, equipment or supplier failure, road traffic problems, terrorism or war.
Voucher, Offers and discounts
The gift voucher is not a cheque guarantee, credit or charge card. It can be used only to make purchases on our Website. When you use the gift voucher on the website, the value of your code will be deducted from the total amount of your shopping basket on the checkout pages. The gift voucher cannot be used to pay for any applicable delivery fees. You will be responsible for any applicable delivery fees. The gift voucher cannot be redeemed or exchanged for cash. Refunds will not be given for the purchase of a gift voucher. If the gift voucher is not used within 12 months of its issue date, it will automatically expire at the end of that period.
We may offer discounts or provide special offers for the purchase of Products. Any such offer or discount shall always be subject to the eligibility criteria and the terms and conditions set out on our Website. Offers and discounts are always granted at our own sole discretion. Repeated or recurring offers or discounts create no claim/title or right that Users may enforce in the future. Depending on the case, discounts or offers shall be valid for a limited time only or while stocks last.
Statutory Rights and Applicable Law

We both agree to the exclusive jurisdiction of the courts of England and Wales.

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded from our contractual relationship with you so that no third party may claim any rights under that contractual relationship (but this shall not affect any right or remedy of a third party which exists or is available apart from that Act).
